By accessing or using CheaprNYC ("Cheapr," "company," "we," "us," or "our") and its services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after updates constitutes acceptance.
You must be at least 13 years old to use the Service. To participate in the Contributor Earnings Program and receive payouts, you must be 18 years or older, a U.S. resident, and have a valid PayPal account.
You are responsible for maintaining the security of your account credentials. Do not share your account or use another user's account. We reserve the right to suspend, terminate, or limit accounts at our discretion for violations of these Terms or other abusive behavior.
If you sign in using Google, Facebook, or Apple, you are also subject to those providers' terms of service and privacy policies. We do not control third-party authentication providers.
By submitting prices or other content ("Community Content"), you confirm that:
You grant Cheapr a perpetual, worldwide, royalty-free, transferable license to display, distribute, modify, and use your submissions in connection with the Service. A price may be labeled Verified when our systems detect sufficient independent signed-in submissions for the same product and store within a short window, when moderators verify it, or when it is ingested from an approved import — as described on our FAQ (Verified prices). We may change these rules and reserve the right to remove or modify any submission at our discretion.
Community Content may remain publicly visible even if your account is deleted. Upon account deletion, personal identifiers may be removed or anonymized.
Earnings are not guaranteed. Rates and program availability are subject to change. Past earnings of other contributors do not guarantee your own earnings.
Cheapr may credit earnings for price submissions, verifications, streaks, referrals, and other engagement actions at rates determined by us. General program terms include:
Launch Campaign Rewards
From time to time, Cheapr may run time-limited promotional campaigns that offer additional bonuses (such as a first-submission bonus, streak bonuses, first-reporter bonuses, or referral bonuses) beyond the standard per-submission rate. The following terms apply to any such campaign:
Referral Bonuses
If a referral bonus program is active, you may earn a bonus when a person you refer to the platform creates an account using your referral link and submits their first price. Referral bonuses are tiered (early referrals may earn less than later ones) and are subject to per-user referral caps. Self-referrals are prohibited. Referral bonuses are only credited upon the referred user's first qualifying submission, not upon account creation.
Balances at Campaign End
When a time-limited campaign ends, any earned balance remains in your account and is payable via the standard payout process. Balances below the minimum payout threshold may, at our discretion, be converted to non-cash platform credits (such as Cheapr Points redeemable for platform features) in lieu of cash payout. We will provide at least 14 days' notice before any such conversion.
You are solely responsible for reporting any earnings from the Contributor Program as income for tax purposes. Cheapr may issue tax forms (such as 1099-NEC or 1099-K) to users who meet applicable reporting thresholds. Earnings will be reported to the IRS.
We reserve the right to pause, suspend, or terminate the Contributor Earnings Program at any time. In the event the ongoing program is discontinued (not a scheduled campaign end), users with balances above the minimum payout threshold will be given 30 days' notice and the opportunity to request payout before the program closes.
Upon account termination for violations of these Terms, any earned balance may be forfeited. Upon voluntary account closure, balances above the minimum payout threshold will be processed within 30 days, provided no fraud or violations are found.
Cheapr Pro is a paid subscription ($5.99/month) providing premium features including price drop alerts, extended price history, Watchlist, and a Pro badge. Payments are processed via Stripe.
The Watchlist feature allows you to track products and receive price drop alerts via email and/or push notification. Alert delivery is not guaranteed (e.g., emails may be filtered to spam; push notifications require device and app permissions). We are not liable for missed or delayed alerts.
The Ask AI feature provides informational suggestions only and does not constitute professional advice. CheaprNYC is not responsible for decisions made based on AI-generated responses. AI output may be inaccurate or outdated. You use this feature at your own risk.
Your username and submission count may be publicly displayed on the Deal Scout leaderboard. Rankings are calculated based on verified submissions. Contact us to request removal from public rankings.
If you use the Community button or any external links (e.g., Discord, social platforms), those platforms have their own terms of service and privacy policies. We do not control third-party platforms.
You agree not to:
Prices on CheaprNYC are community-submitted and may not reflect current in-store prices. Always verify before making purchasing decisions. We do not guarantee accuracy or completeness of price data on this platform. Some prices are submitted by community contributors who earn small payments per submission. All submissions are independently verified where possible.
CheaprNYC does not endorse, verify, or promote any pricing that may violate applicable price gouging laws. Users are responsible for the accuracy of their submissions.
Feedback, suggestions, and ideas you submit (via the Feedback form or otherwise) become the property of CheaprNYC. We may use them without compensation or attribution. You waive any claims to intellectual property in such submissions.
14.1 Our IP. Cheapr and its licensors own and will keep all rights, title, and interest in and to the Service and all related technology and materials, including the software, code, user interface, design, text, graphics, logos, trademarks, and other content (collectively, the “Cheapr IP”). You do not receive any ownership rights in the Cheapr IP.
14.2 Limited permission to use the Service. We grant you a personal, limited, revocable, non-exclusive, non-transferable license to access and use the Service for your own non-commercial use, subject to these Terms.
14.3 Restrictions. Except to the extent allowed by law, you may not (and may not allow anyone else to): (a) copy, modify, or create derivative works of the Service; (b) reverse engineer, decompile, or attempt to discover the source code of the Service; (c) rent, sell, sublicense, or commercially exploit the Service or Cheapr IP; or (d) remove or alter any proprietary notices.
14.4 Your submissions. Content you submit through the Service is licensed to Cheapr as described in Section 4.
14.5 No implied rights. Any rights not expressly granted by Cheapr are reserved.
You agree to indemnify, defend, and hold harmless CheaprNYC (“Cheapr,” “Company,” “we,” or “us”), its affiliates, officers, and employees from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your submissions or content, your violation of these Terms, or your violation of applicable law.
16.1 Suspension or termination. We may suspend or end your access to the Service at any time, with or without notice, including to enforce these Terms or to address suspected fraud, misuse, or security issues.
16.2 Effect of termination. If your account ends (by you or by us), your right to use the Service ends immediately, and we may deactivate your account.
16.3 Pending or unpaid earnings. If the Service offers earnings, rewards, or other payments, amounts are earned only as described in the applicable program terms (if any). We may withhold, adjust, or reverse unpaid or pending amounts in connection with suspected violations, fraud, misuse, abuse, chargebacks, or other invalid activity, to the extent permitted by law.
16.4 Public posts. Community Content you posted publicly may remain publicly visible after your account ends.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” AND YOU USE IT AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR SERVERS ARE FREE OF HARMFUL COMPONENTS. COMPANY MAKES NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY OF ANY CONTENT, INCLUDING USER-SUBMITTED OR THIRD-PARTY INFORMATION, OR THAT ANY PRICING, DEALS, OR SAVINGS WILL BE VALID OR HONORED. THE SERVICE MAY BE MODIFIED, SUSPENDED, OR DISCONTINUED AT ANY TIME.
YOU ARE RESPONSIBLE FOR VERIFYING INFORMATION BEFORE RELYING ON IT AND FOR MAINTAINING APPROPRIATE BACKUPS. NO INFORMATION OR ADVICE, WHETHER ORAL OR WRITTEN, PROVIDED BY COMPANY OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY SET FORTH IN THESE TERMS.
In this Section 17, “Company” means CheaprNYC / Cheapr and its operators.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO COMPANY IN THE 12 MONTHS PRECEDING THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD, OR FOR ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
In this Section 18, “Company” means CheaprNYC / Cheapr and its operators.
Arbitration. Except as provided under Injunctive Relief, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a “Dispute”) will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration venue and governing law. The arbitration will be held in New York County, New York, and judgment on the award may be entered in any court of competent jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act.
Informal notice. Before initiating arbitration, you will send CheaprNYC a written notice of the Dispute and the relief requested and allow 30 days to attempt informal resolution. Notices must be sent to [email protected] with the subject line “Dispute Notice” and must include a sufficient description of the dispute and the relief you seek. You may also send a copy via our contact form, referencing the same Dispute.
Injunctive relief. Either party may seek temporary or preliminary injunctive relief in a court in New York County, New York to prevent immediate and irreparable harm. This does not waive arbitration of any other Dispute.
No class actions. Disputes will be brought only on an individual basis. No Dispute may be brought as a class, collective, consolidated, or representative action, and the arbitrator may not preside over any such proceeding.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, it will be enforced to the fullest extent permitted by law and, if necessary, modified only as much as needed to make it enforceable. The remaining provisions will remain in full force and effect.
If a court of competent jurisdiction determines that a provision cannot be modified to make it enforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
If you believe content on our platform infringes your copyright, send a notice to [email protected] with the information required under 17 U.S.C. § 512(c)(3). We will process valid takedown requests in accordance with the Digital Millennium Copyright Act.
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.
